Court decision sends a strong message, says Mayor of Tweed Shire

Mayor of Tweed Shire Warren Polglase said the recent decision to dismiss with costs the appeal on the decision on the seniors living development known as The Point in the NSW Court of Appeal is a strong vindication of the council’s planning processes.
“Our planning staff has been exonerated by this decision and it clearly demonstrates our planners use integrity in our planning principles,” Councillor Polglase said.
“The decision confirms the planners addressed the issues as required from a merit point of view.
“Statements have been made in the press that this decision is going to be re-challenged. I would suggest these parties reconsider their position as council will be pursuing costs along with the other respondent.”
Hastings Point Progress Association Inc was appealing a NSW Land and Environment Court decision handed down last year.
The planners’ recommendation to approve The Point was endorsed by the Administrators of Tweed Shire Council in May 2007.
